(1) The provider of the BaKIM web application (hereinafter “web application”) is the City of Bamberg, Smart City Bamberg, Promenadestraße 6a, 96047 Bamberg (hereinafter “provider” or “we”).
(2) The web application enables authorised users (Section 2) to upload aerial imagery for automated AI-assisted analysis of tree populations. The analysis comprises individual tree detection, tree genus identification, vitality assessment, and mistletoe detection.
(3) Use of the web application is currently free of charge.

Section 2 – Registration and User Account

(1) The use of this web application is permitted exclusively for authorised users (para. 2) in compliance with the applicable General Terms of Use.
(2) Authorised users are registered municipal bodies represented by a designated contact person (a natural person in an employment or service relationship with the municipal body at the time of use) specified during registration who uses the web application. Municipal bodies may register multiple user accounts, provided that each account is associated with a different contact person.
(3) Users and their contact persons are obliged to keep their access credentials confidential and to protect them from access by third parties.
(4) User accounts are non-transferable.

Section 3 – Uploaded Data

(1) The user guarantees that it holds all necessary rights to the uploaded aerial images and that these do not infringe any third-party rights.
(2) The user undertakes not to upload any aerial images containing identifiable persons, vehicle registration plates, third-party properties, or other personal data of third parties. Should such data be unintentionally included, it must be rendered unrecognisable before uploading.
(3) By uploading data, the user grants the provider the right to process the data for the purpose of analysis and to make the results available to the user.
(4) The user shall indemnify the provider against all third-party claims asserted in connection with legal violations relating to the uploaded data.

Section 4 – Analysis Results and Disclaimer

(1) The analysis results are generated by artificial intelligence (deep neural networks). The results constitute an automated estimate and make no claim to completeness or accuracy.
(2) The analysis results do not release the user from its duty to ensure traffic safety. In particular, they do not replace on-site tree inspections by qualified personnel.

• The accuracy of the models varies by analysis type. In cases of insufficient raw data quality, the accuracy may fall significantly below the values stated on the overview page at https://bakim.bamberg.de/model/.

• The AI models were trained on data with specific characteristics (see data specifications). The greater the deviation of the uploaded aerial images from these specifications (e.g. with regard to ground resolution, acquisition period, or sensor type), the greater the discrepancy between training and application data (domain shift) and the more unreliable the results may be.

(3) The provider makes no warranty as to the accuracy, completeness, or fitness of the results for a particular purpose.
(4) The provider shall not be liable for damages arising from the use of the analysis results, in particular not for decisions made on the basis of the results. This does not apply to damages resulting from injury to life, body, or health, or to damages caused intentionally or through gross negligence.
(5) The results are made available to the user for download. The provider does not store the results permanently.

Section 5 – Availability

The provider operates the web application as part of a research project for an indefinite period. There is no entitlement to a particular level of availability or to the permanent operation of the web application. The provider reserves the right to restrict, modify, or discontinue the web application at any time.

Section 6 – Termination of the User Relationship

(1) The user may terminate the user relationship at any time by deleting its user account.
(2) The provider may terminate the user relationship without notice in the event of a breach of these terms of use.

Section 7 – Amendments to the Terms of Use

The provider reserves the right to amend these terms of use. Amendments will be communicated to the user by email at least four weeks before they take effect. If the user does not object within two weeks of receipt of the notification, the amended terms shall be deemed accepted.

Section 8 – Final Provisions

(1) The law of the Federal Republic of Germany shall apply.
(2) Our privacy policy at [LINK TO PRIVACY POLICY] shall apply.
(3) Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
